Acceptance of Terms

By downloading, installing, or using the Phlashcards application ("App") on any platform — including Apple iOS and Android — you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the App.

If you do not agree to these Terms, do not download or use Phlashcards. Your continued use of the App after any modification to these Terms constitutes your acceptance of the updated Terms.

Who We Are

Phlashcards is a product of Hodge Podgin LLC, a limited liability company organized under the laws of the Commonwealth of Kentucky, United States ("we," "us," or "our"). Hodge Podgin LLC is a creative product studio responsible for the design, development, and maintenance of the Phlashcards application.

References to "Phlashcards," "the App," "the Service," or "the product" in these Terms all refer to the Phlashcards mobile application and any associated services provided by Hodge Podgin LLC.

The App

Phlashcards is a comprehensive cybersecurity certification exam preparation application available on the Apple App Store and Google Play Store. The App provides flashcard-based study content and practice exams for multiple certification tracks, including but not limited to CompTIA Security+, CompTIA PenTest+, CompTIA CySA+, CompTIA Network+, CompTIA A+, ISC² CISSP, AWS certifications, and Security AI (SecAI) certifications.

The App uses the SM-2 spaced repetition algorithm to intelligently schedule flashcard reviews — showing you each card at the optimal moment to maximize long-term memory retention.

Core features of the App include:

• Multiple Certification Tracks — Access to 4,000+ flashcards across CompTIA (Security+, PenTest+, CySA+, Network+, A+), ISC² (CISSP), AWS, and Security AI certifications
• Practice Exams — 20+ full-length practice exams designed to simulate actual certification testing conditions
• Smart Scheduling — SM-2 algorithm-based review timing tailored to each individual card and your personal performance
• Domain-Specific Study — Content organized by exam domains and objectives aligned with official certification blueprints
• Swipe-Based Review — Gesture-driven card review with confidence ratings
• Deep Dive Explanations — Detailed explanations for complex concepts beyond simple definitions
• Study Streaks — Daily streak tracking and visual heatmap of your study history
• Earned Badges — Achievement milestones based on correct answers and consistency
• Progress Analytics — Retention rate, mastered card counts, session history, and intelligent progress tracking
• Offline-First Design — Full functionality without requiring an internet connection
• Deck Sharing — Export and import of flashcard decks in JSON format
• Optional In-App Purchases — Additional certification tracks and features available for purchase as described in Section 5

We reserve the right to modify, suspend, or discontinue any feature of the App at any time with or without notice.

Eligibility

You must be at least 13 years of age to use Phlashcards. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you are using the App on behalf of an organization, school, or institution, you represent that you have the authority to agree to these Terms on that entity's behalf.

By using Phlashcards, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into a binding agreement
• Your use of the App does not violate any applicable law or regulation

In-App Purchases

Phlashcards is free to download and includes access to select certification content. Optional in-app purchases may be available to unlock additional certification tracks, premium features, or content ("Purchases"). These may include:

• Individual certification track unlocks (e.g., Security+, PenTest+, CISSP, AWS, etc.)
• All-access bundles providing unlimited access to all certification content
• Premium features such as scan-to-flashcards or AI-powered study tools
• Additional practice exam packs

All Purchases are:

• Processed through the Apple App Store or Google Play Store, depending on your platform, and governed by that platform's payment terms
• Final and non-refundable, except as required by applicable law or as expressly provided in the platform's refund policy
• Non-transferable and tied to your platform account
• Subject to loss if you delete the App or your platform account without backing up your data

To request a refund for an in-app purchase, please contact Apple or Google directly through their respective support channels, as all billing is managed by those platforms — not by Hodge Podgin LLC.

Your Content

Phlashcards allows you to create, store, and share flashcard decks ("User Content"). All User Content is stored locally on your device. We do not collect, transmit, or store your flashcard content on any server operated by Hodge Podgin LLC.

You own your decks. All flashcard content you create in Phlashcards belongs to you. We make no claim to ownership of your User Content.

When you export a deck as a JSON file and share it with others, you are solely responsible for that content. By sharing a deck, you represent that:

• You own or have the right to share the content in the deck
• The content does not infringe any third-party copyright, trademark, or intellectual property rights
• The content does not contain material that is unlawful, harmful, defamatory, or obscene
• You have obtained any necessary permissions for content derived from third-party sources

Hodge Podgin LLC is not responsible for User Content created, exported, or shared by users. We have no ability to monitor, review, or remove content that exists solely on your device.

Acceptable Use

You agree to use Phlashcards only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• Use the App to develop a competing product or service
• Circumvent, disable, or otherwise interfere with security features of the App
• Use the App in any way that could damage, disable, overburden, or impair its functionality
• Misrepresent the source of any exported deck content
• Use the App to distribute content that is harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Use automated tools, bots, or scripts to access or interact with the App
• Violate any applicable local, national, or international law or regulation while using the App

Intellectual Property

The Phlashcards application — including its name, logo, design, interface, code, animations, and all content created by Hodge Podgin LLC — is the exclusive intellectual property of Hodge Podgin LLC and is protected by applicable copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Copy, reproduce, or distribute any portion of the App
• Modify or create derivative works based on the App
• Sublicense or sell access to the App
• Use any Hodge Podgin LLC or Phlashcards trademarks without express written permission

The "Phlashcards" name, the Hodge Podgin LLC name, and all associated logos and marks are trademarks of Hodge Podgin LLC. Nothing in these Terms grants you any right to use those marks.

Third-Party Certification Trademarks: Phlashcards is not affiliated with or endorsed by CompTIA, ISC², Amazon Web Services (AWS), or any other certification body. CompTIA®, Security+®, PenTest+®, CySA+®, Network+®, and A+® are registered trademarks of CompTIA, Inc. CISSP® is a registered trademark of ISC², Inc. AWS® and related trademarks are property of Amazon.com, Inc. or its affiliates. All certification names, exam codes, and related marks are the property of their respective owners and are used for identification and educational purposes only. All content in the App is independently developed by Hodge Podgin LLC for educational and practice purposes.

Privacy & Data

Phlashcards is designed with privacy as a foundation. We do not collect personal data. All flashcard content, practice exam results, study progress, streak data, and analytics are stored locally on your device using your device's local storage.

Specifically:

• No account creation is required to use Phlashcards
• No personal information is transmitted to servers operated by Hodge Podgin LLC
• Your study history, practice exam scores, decks, streaks, and badges exist only on your device
• Deleting the App will delete all associated data — this action is irreversible
• We use Cloudflare email protection on our support contact to protect against spam

While we do not collect personal data, third-party platforms (Apple App Store, Google Play) may collect data related to your download and purchase activity in accordance with their own privacy policies.

Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Hodge Podgin LLC disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the App will be uninterrupted, error-free, or secure
• Any warranty that defects will be corrected
• Any warranty regarding the accuracy or reliability of any information provided through the App

Certification Exam Preparation: Phlashcards is an independent study tool and is not affiliated with or endorsed by any certification body. While our flashcard content and practice exams are designed to align with official certification exam objectives, Hodge Podgin LLC makes no guarantee that using Phlashcards will result in passing any certification exam. Actual certification exams are administered by independent testing organizations and may contain material not covered in the App.

Practice Exams: The practice exams provided in the App are educational tools designed to help you assess your knowledge and identify areas for further study. They are not official certification exams and do not guarantee performance on actual certification tests. Practice exam questions are independently developed and may not reflect the exact format, difficulty level, or question types of actual certification exams.

The SM-2 algorithm and spaced repetition methodology are established memory science techniques. However, Hodge Podgin LLC makes no guarantee of specific learning outcomes, academic results, memory performance, or certification exam pass rates for any individual user.

You assume all risk associated with your use of the App, including any reliance on its content, scheduling, analytics features, or practice exam results.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HODGE PODGIN LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, goodwill, or business opportunities
• Damages arising from your inability to use the App
• Damages resulting from loss of locally stored data due to device failure, App deletion, or operating system changes
• Damages arising from the content of any imported or exported flashcard decks

In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, Hodge Podgin LLC's liability is limited to the maximum extent permitted by law.

In no event shall Hodge Podgin LLC's total aggregate liability to you exceed the greater of (a) the total amount you paid for in-app purchases in the twelve months preceding the claim, or (b) fifty US dollars ($50.00).

Third-Party Services

The App is distributed through the Apple App Store and Google Play Store. Your use of those platforms is governed by Apple's and Google's respective terms of service and privacy policies, which are independent of these Terms.

Any flashcard decks shared by third parties and imported into the App are user-generated content. Hodge Podgin LLC is not responsible for and does not endorse the accuracy, completeness, or appropriateness of any third-party deck content you import.

Links or references to third-party websites or services — if any appear in the App — are provided for convenience only. Hodge Podgin LLC has no control over and accepts no responsibility for any third-party content, products, or services.

Termination

These Terms remain in effect for as long as you use the App. You may terminate your agreement to these Terms at any time by deleting the App from your device.

We reserve the right to suspend or terminate your access to the App — or to discontinue the App entirely — at any time and for any reason, with or without notice. Grounds for termination include but are not limited to a material breach of these Terms.

Upon termination, all locally stored data associated with the App may be deleted from your device. Sections of these Terms that by their nature should survive termination (including but not limited to Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) shall remain in effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the state and federal courts located in Kentucky. By using the App, you consent to the personal jurisdiction of such courts.

If you are located outside the United States, you acknowledge that your use of the App is subject to United States law, and you waive any objection to jurisdiction or venue in Kentucky.

Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, applicable law, or our business practices. When we do, we will update the "Effective" date at the top of this page.

For material changes, we will make reasonable efforts to notify you — such as through an in-app notice or an update to the App Store listing. Your continued use of Phlashcards after any change to these Terms constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree to a material change, your only recourse is to stop using the App and delete it from your device.
